1. Acceptance of Terms
By accessing or using SaylorScope ("the Service"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not access or use the Service. These Terms constitute a legally binding agreement between you and Conor Chepenik ("we," "us," or "SaylorScope").
2. Definitions
For purposes of these Terms:
- "Service" means the SaylorScope website, application, tools, features, and any related services provided by us.

- "Third-Party Services" means any external services, APIs, libraries, data providers, or websites not owned or controlled by SaylorScope.

THE SERVICE DOES NOT PROVIDE FINANCIAL, INVESTMENT, TAX, OR LEGAL ADVICE. All Content, including AI-Generated Content, analyses, projections, scenarios, and information provided by the Service are for INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY.
You expressly acknowledge and agree that:
- SaylorScope does not make any suitability determination regarding any financial product, strategy, or decision for you.
- No fiduciary duty, advisory relationship, or advisor-client relationship is created between you and SaylorScope by your use of the Service.
- The Service does not take into account your specific financial situation, investment objectives, risk tolerance, or personal circumstances.
- You have an independent duty to consult with qualified financial advisors, tax professionals, and legal counsel before making any financial decisions.

- FITNESS FOR A PARTICULAR PURPOSE
- TITLE AND NON-INFRINGEMENT
- WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE
We make NO GUARANTEES regarding:
- The accuracy, completeness, reliability, or timeliness of any Content or analysis
- Bitcoin or any asset's future performance or value
- The outcomes of any leverage strategy, investment, or financial decision
- The availability, uninterrupted operation, or error-free performance of the Service
- That the Service will meet your requirements or expectations
- That defects will be corrected or that the Service is free of viruses or harmful components
5. AI-Generated Content Disclaimer
SaylorScope uses artificial intelligence to generate financial analyses. You acknowledge and agree that AI-Generated Content:
- Is probabilistic in nature and may be incorrect, incomplete, misleading, outdated, or entirely fabricated
- May contain errors, hallucinations, or inaccuracies that are not immediately apparent
- Should never be relied upon as the sole or primary basis for any financial decision
- Does not reflect your complete financial picture, circumstances, or needs
- Is not a substitute for professional financial, legal, or tax advice
- May not reflect current market conditions, regulations, or other relevant factors
YOU ASSUME ALL RISK ARISING FROM YOUR USE OF OR RELIANCE ON AI-GENERATED CONTENT. We are not responsible for any decisions, actions, or outcomes based on AI-Generated Content.
6. User Responsibilities
By using the Service, you agree that:
- You are solely responsible for all decisions you make, whether or not influenced by Content from the Service.
- You will independently verify all outputs, analyses, and information before taking any action.
- You will comply with all applicable laws, regulations, and tax obligations in your jurisdiction.
- You will not use the Service for any unlawful purpose or in violation of these Terms.
- You are responsible for maintaining the security of your account credentials and access to the Service.
- You will provide accurate information when using the Service and understand that inaccurate inputs will produce inaccurate outputs.
7. Assumption of Risk and Limitation of Liability
You acknowledge that:
- Investing in Bitcoin and using leverage involves substantial risk of loss, including potential loss of your entire investment
- Past performance does not guarantee future results
- Cryptocurrency markets are highly volatile and unpredictable
- You could lose some or all of your investment
LIMITATION OF LIABILITY:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CONOR CHEPENIK, SAYLORSCOPE, OR ANY OF THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or data
- Loss of goodwill or reputation
- Cost of substitute services
- Financial losses from investment decisions
- Any other intangible losses
ARISING FROM OR RELATING TO: your use or inability to use the Service; any Content or AI-Generated Content; any financial decisions made based on information from the Service; unauthorized access to or alteration of your data; Third-Party Services; or any other matter relating to the Service.
LIABILITY CAP: TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) ONE HUNDRED U.S. DOLLARS ($100.00); OR (B) THE TOTAL AMOUNTS PAID BY YOU TO SAYLORSCOPE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
8. Indemnification
You agree to indemnify, defend, and hold harmless Conor Chepenik, SaylorScope, and their affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any financial decisions or actions you take based on Content from the Service.
9. Intellectual Property and License
Ownership: SaylorScope and its licensors own all right, title, and interest in and to the Service, including all intellectual property rights therein. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries.
License to Use Service: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. This license does not include the right to: (a) modify, copy, or create derivative works of the Service; (b) reverse engineer or attempt to extract the source code; (c) sell, sublicense, or transfer your rights; or (d) use the Service for any commercial purpose without our prior written consent.
User Content: You retain ownership of your User Content. By submitting User Content to the Service, you grant us a limited, non-exclusive license to process such content solely for the purpose of providing the Service to you. We do not claim ownership of your User Content, and given our client-side processing architecture, we do not retain your User Content after your session ends.
10. Third-Party Services
The Service may incorporate, rely upon, or link to Third-Party Services, including but not limited to: external APIs, data providers, AI models, libraries, payment processors, and websites.
You acknowledge and agree that:
- Third-Party Services are not owned or controlled by SaylorScope.
- We are not responsible for the content, accuracy, availability, or practices of Third-Party Services.
- Third-Party Services are provided "as is" without any warranty from us.
- Your use of Third-Party Services may be subject to additional terms and conditions.
- We are not liable for any damages or losses arising from your use of or reliance on Third-Party Services.
11. Data Privacy and Security
Your financial data is processed client-side in your browser and is not transmitted to or stored on our servers beyond what is necessary for the analysis request. We do not have persistent access to your financial information after an analysis session ends.
You acknowledge and agree that:
- We do not guarantee the security of your device, browser, browser extensions, network connection, or local storage.
- We are not liable for any data breaches, unauthorized access, or security incidents arising from vulnerabilities in your computing environment.
- You are responsible for maintaining the security of your own devices and network connections.
- Data transmitted over the internet may be subject to interception by third parties.
12. Suspension and Termination
We reserve the right, in our sole discretion and without prior notice or liability, to suspend, restrict, or terminate your access to the Service, in whole or in part, at any time and for any reason, including but not limited to:
- Violation of these Terms
- Suspected fraudulent, abusive, or illegal activity
- Requests by law enforcement or government agencies
- Operational, technical, or security concerns
- Extended periods of inactivity
- Discontinuation or material modification of the Service
Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to: Disclaimer of Warranties, Limitation of Liability, Indemnification, and Dispute Resolution.
13. Age Requirement
You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are under 18, you may not access or use the Service.
14. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service, including the formation, interpretation, breach, or termination thereof, shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall take place in the State of Florida, and the arbitrator's decision shall be final and binding.
Class Action Waiver: YOU AND SAYLORSCOPE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class, collective, or representative proceeding.
Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court if the claim qualifies for such court's jurisdiction.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to @ConorChepenik on X (Twitter) within 30 days of first accepting these Terms. If you opt out, the Governing Law and Venue provisions below shall apply.
Severability of Arbitration Provisions: If any portion of this arbitration agreement is found to be unenforceable, the remaining portions shall remain in full force and effect. If the class action waiver is found to be unenforceable, then the entirety of this arbitration agreement shall be null and void, and disputes shall be resolved in accordance with the Governing Law and Venue provisions below.
15. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.
For any disputes not subject to arbitration, or where arbitration is found unenforceable, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Florida. You waive any objection to venue in such courts and agree not to assert that such forum is inconvenient.
16. Modifications to Terms
We reserve the right to modify, update, or replace these Terms at any time in our sole discretion. Updated Terms will be posted on the Service with a revised "Last Updated" date and become effective immediately upon posting.
We may, but are not obligated to, provide notice of material changes through the Service or other means. It is your responsibility to review these Terms periodically for changes.
Your continued use of the Service after the posting of revised Terms constitutes your acceptance of and agreement to be bound by the modified Terms. If you do not agree to the revised Terms, you must stop using the Service.
17. Miscellaneous
Entire Agreement: These Terms, together with any policies or guidelines incorporated by reference, constitute the entire agreement between you and SaylorScope regarding the Service and supersede all prior agreements and understandings.
Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.
Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may freely assign these Terms and our rights and obligations hereunder without restriction. Subject to the foregoing, these Terms shall bind and inure to the benefit of the parties and their respective successors and assigns.
Headings: Section headings are for convenience only and shall not affect the interpretation of these Terms.
